Can I stay in the house during the divorce and
have my spouse removed?
This issue depends on state law. Factors that may effect whether
a judge will order a party to move from the marital home include
physical or emotional abuse perpetrated by that party and whether
it is settled that the party asking to stay in the home will have custody
of minor children. Economic factors may also be considered. Be
